Google Inc (NASDAQ:GOOG) 7-year Case Refused by Judge to Defer


Internet search giant Google Inc (NASDAQ:GOOG)’s appeal of a federal judge’s decision to grant authors class certification has come a cropper with the judge concerned refusing to defer a related seven-year old case pertaining to its plans to create the world’s largest digital library.
Google appealed the class-certification ruling – passé in May - and asked to delay all proceedings until the 2nd U.S. Circuit Court of Appeals rules.
U.S. Circuit Judge Denny Chin however said that such a delay was not warranted since it would hold up the case for some more years.
"The merits would have to be reached at some point in any event, and there simply is no good reason to delay matters further," the judge wrote.
He found Google’s argument surprising that it would be unfair to decide the merits of the case while the authors were deciding whether to opt out of the class, especially "in light of Google's fervent opposition to class certification."
Chin scheduled an oral argument in October on requests by lawyers that he decide issues without a jury.
Google has already scanned more than 20 million books for the project. The Authors Guild had requested class certification, saying it was impractical and expensive for each author to sue Google over similar claims.
The Authors Guild wanted $750 in damages for each copyrighted book Google copied. It has argued that Google was not making "fair use" of copyright material by offering snippets of works in its online library.

AMR Corporation (PINK:AAMRQ): Financing from Creditors a Possibility


The parent of American Airline, AMR Corporation (PINK:AAMRQ), is in talks with a “group of substantial creditors” who might provide funds as part of the company’s bankruptcy reorganization plans.  In a filing in the U.S.  Bankruptcy Court in Manhattan, the Fort Worth, Texas-based company has mentioned that these creditors are willing to participate in AMR’s restructuring plans.  It says, “The negotiations with the group are an integral part of American’s efforts to move forward to achieve the objectives of Chapter 11.” It goes on to say that “the commitments, if obtained, will facilitate the proposal and confirmation of a chapter 11 plan”.

The company is also willing to consider the option of merging with another airline.  U.S.  Airways Group Inc. has already expressed its interest in such a merger publicly. This ad hoc creditors group is distinct from the committee of unsecured creditors, which actually has a greater say in American’s reorganization plans.  However, in bankruptcy cases, it is often seen that other creditors also significantly influence the reorganization process.

According to AMR spokesman Sean Collins, large debtors wanting to be a part of reorganization planning is not all that unusual.  He has said, “These debt holders have a direct interest in ensuring that AMR emerges as a healthy company.”

The airline has asked for permission to pay the legal expenses of the creditors’ group.  "It also is not uncommon for the debtor to pay fees related to this effort,” said Collins.

Microsoft Corporation (NASDAQ:MSFT) Windows Phone 8 Likely to Launch on Oct. 29


On Tuesday Korean consumer electronics giant Samsung announced the launch of its first phone, ATIV S, running on Windows 8 mobile operating software. On September 5, Nokia Corporation (ADR)(NYSE:NOK) is expected to launch its new smartphone running on Windows 8.
But the launch of Windows Phone 8 software itself has been shrouded in some mystery.
According to ZDNet, which is closely tracking events, Microsoft Corporation(NASDAQ:MSFT) is set to launch its new mobile operating software on October 29. This is right three days after the company is scheduled to launch the Windows 8 for personal computers, the upgrade after Windows 7.
ZDNet has even zeroed in on the venue of the launch, saying that I could somewhere on the West Coast – either in San Francisco or Los Angeles.
However the software is not expected to start retailing till November – which was anyway originally when the rumours mills had pegged it to make an appearance.
Those who have been on the trail of Windows Phone 8 say that it is a definite big improvement over Windows Phone 7.5 or Mango that has somehow not been as popular as expected. Nokia’s Lumia series runs on Windows Mango, and there have been complaints from customers about compatibility issues with other operating systems.
The new version of the Windows OS supports higher resolution screens including the 720p display in the ATIV S. It also adds support for dual-core processors and microSD cards. For users that means faster phones with better screens and more storage.
The new mobile OS also offers more customizability. Users can arrange their Start screen in more ways thanks to the variable sizes of live tiles. In Windows Phone 8 there’s a new small option for tiles which let users put more tiles onscreen at once, though the medium and large tiles are still available.
