Apple Inc. ( AAPL) Appeal for a Permanent Injunction Against Samsung to be Heard in December


Samsung has got a slight reprieve. The hearing in a San Jose federal court to decide on a sales ban on its products has been moved to December 6, from an earlier scheduled date of September 20.

The court, which had awarded more than a billion dollars in damages to Apple Inc.(NASDAQ:AAPL) in its fights against Samsung on patent violations issues, will also be deliberating on Apple's appeal to impose a ban on sales of Samsung devices in the United States.

Samsung had asked for more time to prepare for the hearing and on Tuesday, its request was granted. So Apple's request for a permanent injunction will be considered in December.

On Monday the iPhone maker had made a list of the eight smartphones made by Samsung, against whom it wanted a permanent injunction.

In an order on Tuesday, U.S. District Judge Lucy Koh said that due to the scope of Apple's preliminary injunction request, she believed it was "appropriate" that various post-trial motions be consolidated, Reuters reported.

There will still be a hearing on September 20, but it will be used to hear Samsung's appeal to lift the ban on its Galaxy tab 10.1, earlier imposed in June. The jury verdict last week had held that there was no patent infringement in this case.

Friday's verdict had sent shares of the Korean handset maker reeling while Apple hit record highs. However Samsung shares managed to recoup some of their losses on Tuesday.
